1. Acceptance of Terms

By accessing or using ekstrakt ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including users of our website, mobile applications, and browser extensions.

2. Description of Service

ekstrakt is an AI-powered platform that provides summarization services for YouTube videos. Our Service allows users to:

  • Generate AI-powered summaries of YouTube videos
  • Access different summary types (Short, Detailed, Straight-to-Answer)
  • Ask questions about video content
  • Save and access summary history
  • Use browser extensions and mobile applications for convenient access

The Service relies on third-party content from YouTube and uses AI technology for summarization. We do not host or own any video content processed through our Service.

3. User Accounts

To use certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized access to your account

You must be at least 13 years old to create an account and use the Service. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

4. Subscription and Payments

4.1 Free Trial

New users may receive a limited number of free summary credits. These credits are non-transferable and may expire according to our policies.

4.2 Paid Subscriptions

We offer paid subscription plans that provide unlimited access to our summarization features. By subscribing, you agree to pay the applicable fees as described at the time of purchase.

4.3 Billing

Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). Your subscription will automatically renew unless you cancel before the renewal date.

4.4 Cancellation

You may cancel your subscription at any time through your account settings or billing portal. Upon cancellation, you will continue to have access to the Service until the end of your current billing period.

4.5 Refunds

Unless required by applicable law, subscription fees are non-refundable. We may, at our sole discretion, provide refunds in exceptional circumstances.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Process content that infringes on intellectual property rights
  • Attempt to circumvent usage limits or security measures
  • Share your account credentials with others or allow unauthorized access
  • Use automated systems or bots to access the Service excessively
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to reverse engineer or extract source code from the Service
  • Use the Service for any illegal, harmful, or fraudulent purposes

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by ekstrakt and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

6.2 Third-Party Content

The videos summarized through our Service are owned by their respective creators and are subject to YouTube's Terms of Service. We do not claim ownership of any third-party content.

6.3 Generated Summaries

Summaries generated through the Service are provided for your personal, non-commercial use. You may share summaries, but you may not sell, redistribute, or use them for commercial purposes without our consent.

7. Content and Data

7.1 User Data

We collect and process user data as described in our Privacy Policy. By using the Service, you consent to such processing and warrant that all data you provide is accurate.

7.2 AI-Generated Content

Summaries are generated using artificial intelligence and may contain inaccuracies, omissions, or errors. You should not rely solely on AI-generated summaries for critical decisions. We are not responsible for any actions taken based on generated content.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Results from using the Service will be accurate or reliable
  • The quality of the Service will meet your expectations
  • Any errors in the Service will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EKSTRAKT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless ekstrakt and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through your account settings or by contacting us.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

Your continued use of the Service after any changes to the Terms constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ekstrakt operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of that jurisdiction.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
